A contact may be oral, written, or both. You and I make contractual arrangements unnoticed on a daily basis simply because they are not in writing.
We lack the necessary knowledge to enforce our rights in such contracts.
For example whenever you board a Taxi or a boda boda and both of you agree on a final destination, the driver is in breach of a contract if he fails to take you to your final destination and you are therefore not liable to pay even half.
In most cases people have neglected to enforce oral contracts under a false imagination that they are not provided for under the law. You simply need to have a witness and at times even the recorded audios can be of evidence in case of any denial by any party.
