You can vary the term of a subsisting lease through a variation deed made between the landlord (lessor) and yourself (lessee).

Steps:

  • Reach a consensus with the lessor on variation of the term of the lease.

  • Prepare and sign a variation deed showing the changes made.

  • If the lease was granted by a public body, make an application to them by letter for variation of the lease.

  • The public body then communicates to the KCCA Directorate of Physical Planning to approve the user clause.

  • After this, a variation deed is made.

Note:

  • The variation must be approved by KCCA.

  • If the term of the lease has been altered, then it should be crossed out from the title and the new term inserted.

  • This variation should be registered and the deed then attached to the title.
