The Constitution of the Republic of Uganda entitles every person to a right to personal liberty. However, this right can be suspended if authorized under the law.
An arrest is an act that involves using legal authority to deprive a person of his or her liberty. It may be done for different reasons. An arrested person is usually referred to as a suspect/detainee.
An arrest is initiated to bring the suspect before court or other authority to answer to any charges before him/her; or to enable administration of the law.
Arrests can be made on both criminal charges and civil claims. For arrests on civil claims, there should be a valid court order. Arrests can be effected by a police officer, a Magistrate or a person with authority from a Magistrate and an ordinary person.
While effecting an arrest, a police officer should identify him/herself to the suspect who must be informed of the rationale for the arrest in a language they understand.
Arrests ought to be peaceful and reasonable force should be used only if necessary. A suspect should be taken to a Magistrate or police station without unnecessary delay.
