Successful parties in court cases have taken it upon themselves to execute court orders without following the due process of law
The demolition of buildings, structures and gardens during day and night hours under the guise of giving effect to a court order without following due process is in itself illegal.
The successful party in a court case must apply for execution of a court order at the execution division of the high court. This process enables court to verify the authenticity of the court order.
Then the party seeking for execution has to seek clearance from the RDC/RCC, DPC and the L.C authorities.
Upon clearance, the execution must take place during day time by certified court bailiffs and in the presence of police to ensure that there is law and order.
Obtaining a Judgment alone does not in itself give one the liberty to hire goons and pull down buildings or chase away people from their land.
The commanders of particular police units would therefore be liable in neglect of duty and be subjected to allegations of corruption in case such demolitions take place and yet they are under a constitutional duty to protect people's life and property.
