During the COVID-19 crisis, many people have found themselves stuck in foreign countries, with with some having property in their home countries needing management, others need to enter into and perform contracts; and many of these activities require the people involved on ground.

However, this can be resolved by making use of Powers of Attorney (POAs) through which one can appoint another for a specific purpose for example; to manage and deal in his or her land.

He or she can instruct lawyers here in Uganda to prepare the POA, and make use of electronic communications and ICT tools to conclude the signing process. The POA should be signed by one witness, either within or outside Uganda.

Persons that may witness a POA are specified under the Registration of Titles Act; but if the witness is none of those mentioned, he or she should appear before any of the persons mentioned, who shall sign a certificate on the POA in proof of its completion.

NOTE:

  • POAs should be strict and specific on the scope of authority being conferred; and agents should act strictly within this authority.

  • The signatories should use actual signatures or thumbprint if they cannot sign; but not their names or initials.

  • The POA should be notarized in Uganda if it is sent from abroad.

  • POAs should be registered within four months of its completion, for it to have full force and effect.
