In most cases we have not take steps to find out whether the subject land is actually in issue in one of the ongoing court cases.

The court of appeal has categorically held in Kayabura & 2 Ors v Kahangirwe (Civil Appeal-2015/8smile [2019] UGCA 2048 (12 December 2019, that Whoever buys land which is a subject of court dispute, in itself amounts to fraud on the part of the purchaser.
